Catastrophic Injury and Wrongful Death
“Personal injury” is a broad umbrella term that encompasses nearly any harm someone suffers due to another’s negligence. And many firms embrace this broad approach, taking on all types of cases. But the simple truth is that not all personal injury cases are the same. Some people are fortunate to suffer injuries that they can recover from. Others are not so fortunate and instead suffer catastrophic permanent injuries that will forever impact their lives. And some people die because of their injuries, leaving their families behind to pick up the pieces.
Our firm focuses on the catastrophic and fatal injury cases because we believe that the severity of these cases requires focused attention and resources. Our decades of experience litigating these cases have taught us that there is rarely, if ever, an easy solution. The defendants recognize the risk they face and hire elite law firms to defend them—paying large sums of money to their lawyers to make the problem go away. We have fought defendants in a variety of different contexts in courtrooms across the country, exploring novel theories and digging deep to ensure our clients maximize their recoveries so that they can be put in the best possible position to move forward with their lives.
There is no template for what we do. The only constant theme throughout our cases is a deserving client and an uphill fight. As a result, we have a long track record of taking on a wide-ranging variety of defendants and pursing novel theories to maximize our clients’ recoveries. And we do so on a global scale, having represented clients throughout the country and even outside the U.S. Learn more about our National and International Practice.
A few examples of the types of actions our attorneys have handled include:
- Products Liability: Manufacturers, distributors, retailers, and other businesses which profit from the sale of products have a duty to ensure that they are not releasing dangerous and defective goods into the stream of commerce. Our attorneys have spent decades battling international companies on behalf of consumers injured and killed by defective products. - Negligent Supervision and Security: Businesses have a duty to ensure that their patrons are safe. This duty extends to shopping malls, grocery stores, apartment complexes, restaurants, bars, and nearly any other business that invites members of the public onto their property in the hopes of making money. The law recognizes that the operators of these businesses have a duty to anticipate foreseeable risks posed to their customers. As such, those businesses must supervise their employees and contractors and take reasonable safety measures (e.g., installing security cameras, providing security guards, etc.) to ensure that their customers and others are protected against foreseeable risks and threats. But the sad reality is that businesses often the drop the ball, leaving their customers at undue risk of injury. We have had success in pursuing businesses for such negligent security and supervision, helping to secure life-changing compensation for our clients who suffered needless harm that could and should have been avoided through better practices.
- Negligence by a common carrier: Transportation providers (think taxis, rideshares, busses, trains, etc.) have a heightened duty of care to their passengers, who trust their safety to those businesses while using their services. Unfortunately, our experience has shown that these providers sometimes allow dangerous individuals to work for their companies, and these individuals go on to commit horrible acts like sexual assault on their occupants. Other companies allow unqualified, negligent, and even reckless individuals to drive passengers around, resulting in dangerous situations where passengers and other motorists are harmed. We have successfully represented clients under these circumstances and held these transportation providers accountable.
- Trucking crashes: Semi-trucks and other large work vehicles pose an increased risk of harm due to their size. This means that the businesses that operate and profit from the use of those vehicles should exercise due care to ensure that other drivers and pedestrians are not harmed by those vehicles. Our practice has shown that this is not always the case. Sometimes, these companies put incompetent drivers behind the wheel, or send trucks out on the road with dangerous, unrepaired equipment. We’ve successfully pursued cases against trucking operators, brokers, and others responsible for putting dangerous drivers and trucks out on the road.
- Negligent automobile service: Auto dealers, service facilities, and other businesses are trusted to be the experts in inspecting and repairing vehicles. Customers rely on this expertise to make sure their vehicles are safe for the road. Sadly, these businesses do not always hold up their end of the bargain, failing to detect a dangerous condition in the vehicle or performing deficient repairs. When this occurs, disaster often ensues. We’ve represented many clients whose lives have been shattered by automotive repair facility negligence.
The above list is by no means exhaustive and is simply meant to provide examples of the types of cases we have handled. We take great pride in representing individuals and families against powerful corporations and continue to do so in a variety of different types of cases in courtrooms across the country.
It’s not enough to know how to fight the defendant—a catastrophic injury attorney must also have the experience, knowledge, and compassion needed to understand the client’s predicament and future care needs. We have developed this expertise over decades, representing clients who have suffered a host of catastrophic injuries, including:
- Quadriplegia, paraplegia, and other forms of paralysis and spinal injuries;
- Mild, moderate, and severe brain injuries;
- Fractured femurs, tibulas, fibulas, arms, clavicles, and other broken bones;
- Limb loss and amputations;
- Partial and complete hearing loss;
- Damage to and loss of an eye, diminished eyesight, and blindness;
- Cancers and other chronic illnesses;
- Organ failure and removal; and
- Burns, scars, and other types of disfigurement.
We know, from experience, that these injuries present life-long challenges necessitating specialized medical care and treatment. That’s why we retain medical specialists who can assess the client’s injuries and prognosis, mapping the road to recovery and identifying the types of care and treatment the client will need as they continue onward in their healing journey. Those experts also help tell the story to the defendant, the Court, and the jury, giving a voice to our client and clearly communicating the harm they have and will continue to suffer.
We also partner with vocational experts and economists to develop lifecare plans that demonstrate how the client’s injuries will impair their ability to earn money in the future and document the amount of money they and their families will lose out on because of the injuries suffered. Those experts also help put a dollar figure to the future care needs, including the cost of support and services such as home nursing aids, supportive equipment, modifications to homes and vehicles needed to account for the injuries, and the other measures needed to allow the catastrophically injured to navigate their daily lives.
And, of course, catastrophic injuries also have a strong emotional component. Physical pain, disfigurement, impairments—all of these conditions result in daily suffering in a variety of ways that do not register on x-rays, scans, or other standard medical tests. We understand the pain and suffering that catastrophic injury victims endure. We work with our clients to help give a voice to that suffering, including by working with mental health professionals and others who can help treat and articulate that suffering to the defendant, the Court, and the jury. And we also understand that sometimes the clients themselves have a hard time vocalizing that pain, so we know to interview and speak with their families, friends, coworkers, and others who see that pain and suffering firsthand every day.
The bottom line is that the defendant, the Court, and the jury must be aware of the full extent of your injuries for you to obtain the maximum recovery possible for your case. We bring the experience, insight, and compassion necessary to truly understand your injuries and the toll they take on you and your loved ones. With a proven track record of success, we are committed to securing the maximum financial compensation you deserve under the law.
We’ve seen firsthand the destruction and pain that the death of a loved one inflicts on a family. In addition to the emotional pain, the surviving family is often left with a new difficult financial reality and serious concerns about how bills will be paid after their loved one is unable to help support them. We regularly represent families facing these daunting challenges, counseling them through the process and representing them in wrongful death actions to help restore a strong foundation for moving forward.
We have represented the families of deceased fathers, mothers, spouses, parents, sisters, and children. Each case presents its own challenges, and every family will have their own unique needs moving forward. We have demonstrated the ability to help families navigate these tough circumstances.
Often, the first step in a wrongful death lawsuit is to set up an estate. Our firm has its own probate division that can help our clients do so, holding their hand every step of the way. Learn more about our probate and estate practice.
We are also well-versed in identifying the responsible parties and developing the evidence necessary to pursue the maximum financial compensation available in a wrongful death case. The available monetary damages will vary by the case facts and jurisdiction, but can generally include the following:
- Loss of income and earning ability: which provides compensation for the loss of income the decedent would have otherwise been able to earn for the surviving family members;
- Loss of support and services: which provides compensation for household tasks and other support and services the decedent provided to their family members and loved ones;
- Loss of consortium: which provides compensation for the loss of companionship, comfort, affections, support, protection, solace, and the other intangible benefits flowing from the relationship between spouses, and depending on the jurisdiction, other close loved ones;
- Loss of guidance and instruction: which provides compensation for the loss of a parent by a minor child, who will be left to navigate the world without the guidance and instruction that only a parent can provide; and
- Mental pain and suffering: which provides compensation for the psychological impact the loss has had on the surviving family members and other loved ones.
Of course, these are only generalized categories of damages which may be available, depending again on the facts of your case and the jurisdiction. Additional and different damages may be available—underscoring why it is imperative that you work with an experienced wrongful death attorney to ensure that you are obtaining the full extent of recovery available for the loss of your loved one.
We have spent decades fighting to recover wrongful death damages for families facing the loss of a loved one, learning how to develop the evidence needed to support these claims to the maximum extent possible. Such work often requires careful coordination with economists who can quantity the loss of earning capacity over the course of a lifetime, along with mental health professionals who can help articulate the loss felt by the family. But we have found that the most powerful testimony often comes from the family members themselves, who we work with extensively to help navigate the pain and tell their story.
We are honored to represent individuals and families who have endured some of the most challenging moments of their lives, guiding them toward justice and helping them obtain the compensation they need to heal and rebuild. We have a demonstrated track record of doing so. Learn more about our results.
The bottom line is that our firm specializes and focuses on catastrophic and fatal injury cases. Your case will get the care and attention it deserves if you trust us to guide you through the process and fight on your behalf. You deserve nothing less.
